Terms and Conditions

I. Scope of Contract

The contractual services of Allgäu-Airport-Express GmbH comprise the safe transport of the agreed number of passengers and their luggage to the destination. Additional services such as individual journeys or the provision of a specific type of vehicle must be agreed separately and requested at the time of booking.

§ 1 Conclusion of Contract

A transport contract is only concluded upon written confirmation. If ALLGÄU AIRPORT EXPRESS confirms the customer's registration only in a deviating form, this confirmation shall be considered a new offer. If the customer does not wish to accept this offer, they must reject it within 10 days; otherwise, the offer shall be deemed accepted.

§ 2 Contractual Content

The transport service is defined by the description in the written confirmation issued by ALLGÄU AIRPORT EXPRESS. Following receipt of the written confirmation by ALLGÄU AIRPORT EXPRESS, price changes are excluded.

Verbal side agreements are binding only upon written confirmation. The content of the services also includes, in particular, the agreements regarding the execution of the booked transfer type and its specified conditions.

The price quotations are understood — unless expressly requested and agreed otherwise — as fares for a one-way journey, per person. Additional forms of transfer (Express and exclusive individual transfer) may be agreed upon for a surcharge.

Scheduling — in particular pickup times from the accommodation — is at the sole discretion of ALLGÄU AIRPORT EXPRESS. Among other factors, the usual travel time, the airline check-in requirements and, where applicable, the conditions of our collective shuttle are taken into account. Weather and traffic conditions, as well as other circumstances, may cause short-notice changes to the schedule.

The arrival time stated at the time of booking becomes binding with the booking confirmation. SMS and voicemail messages cannot be accepted as binding. In case of non-compliance, the right to transport lapses without refund of the carriage charge.

Customers and travel agencies are obliged to inform us in writing without delay of any rebookings occurring after receipt of the written confirmation by ALLGÄU AIRPORT EXPRESS. Failure to notify shall extinguish our obligation to provide transport. Rebookings shall be treated as cancellation followed by a new booking and require written confirmation by ALLGÄU AIRPORT EXPRESS.

ALLGÄU AIRPORT EXPRESS shall not be liable for exceptional situations such as flight delays, flight diversions, flight cancellations, pilot or air traffic controller strikes, or adverse weather conditions. ALLGÄU AIRPORT EXPRESS calculates the transfer to the departure airport at 1.5 hours for check-in plus the estimated travel time to the airport. For private transfers, pickup of guests at the accommodation may still change up to one day before departure. Any pickup time deviating from the confirmation will then be communicated by phone at the residential address or directly with the customer.

§ 3 Fare

The fare is determined by the price list valid at the time and requires written confirmation by ALLGÄU AIRPORT EXPRESS.

The fare is to be paid in full upon receipt of the booking confirmation, but at the latest before the start of the journey.

The fare includes the carriage of one suitcase and one piece of hand luggage per person. Additional or oversized luggage (golf or ski equipment, small animals, etc.) must be declared at the time of reservation and may be subject to a charge. Unannounced luggage may not be transported under certain circumstances.

§ 4 Rebooking / Cancellation

Both contractual parties are entitled to withdraw from the transport contract at any time. Withdrawal by the customer or travel agency must be notified to ALLGÄU AIRPORT EXPRESS in writing. The decisive moment for withdrawal is the receipt of notification at ALLGÄU AIRPORT EXPRESS. The following cancellation flat rates and processing fees apply:

Partial refunds or partial rebookings of a ticket are not possible. Refund requests received after the travel date will not be considered.

§ 5 Liability

ALLGÄU AIRPORT EXPRESS shall be liable, in accordance with the standard of care of a prudent businessperson, for the conscientious preparation and proper provision of the contractually agreed transport service. Insofar as insurance cover exists under the statutory liability insurance, ALLGÄU AIRPORT EXPRESS shall be liable to the customer in the event of damage in accordance with the statutory provisions. Insofar as the liability insurance is not obliged to indemnify, the liability of ALLGÄU AIRPORT EXPRESS shall be limited to a maximum of three times the contractually agreed total fare.

ALLGÄU AIRPORT EXPRESS shall otherwise be liable only for intent and gross negligence.

ALLGÄU AIRPORT EXPRESS shall not be liable for the consequences of delays caused by unforeseeable traffic density, flight delays, flight diversions, flight cancellations, pandemic-related delays (e.g. tests, quarantine), missed connecting services (flight, train or bus), air traffic controller strikes, traffic jams, or force majeure.

Departure times from Memmingen Airport may change at short notice. ALLGÄU AIRPORT EXPRESS accepts no liability for any connecting services missed as a result.

The customer is obliged to notify us of any complaints regarding the service in writing without delay, but at the latest within 24 hours after the end of the carriage; otherwise, any claims shall lapse.

§ 6 General Provisions

Should any of the foregoing provisions be invalid, the validity of this contract shall otherwise remain unaffected.

Place of performance and jurisdiction is Memmingen.
